The new CBA Memo of Understanding contains a new rule that allows a player to sign a multi-year 35+ deal that is not front loaded, and they can retire if they want. The cap hit disappears when they do.

The new CBA MOU says this:

64. 35+ Year Old Rule for Cap Counting

CBA §50.5(d)(i)(B)(5) shall have no application to a multi-year SPC that has: (1) total compensation (Player Salary and Bonuses) that is either the same as or increases from one League Year to the immediately subsequent League Year, and (2) a Signing Bonus, if any, that is payable in the first year of the SPC only.

And the relevant CBA passage which is written in the form of a list of what does count against the salary cap:

All Player Salary and Bonuses earned in a League Year by a Player who is in the second or later year of a multi-year SPC which was signed when the Player was age 35 or older (as of June 30 prior to the League Year in which the SPC is to be effective), but which Player is not on the Club’s Active Roster, Injured Reserve, Injured Non-Roster or Non-Roster, and regardless of whether, or where, the Player is playing, except to the extent the Player is playing under his SPC in the minor leagues, in which case only the Player Salary and Bonuses in excess of $100,000 shall count towards the calculation of Averaged Club Salary ...

Parsing out the meaning of this change: As long as the 35+ contract meets the conditions in the MOU, it won’t count fully against the cap if the player is no longer on the roster. In other words, if they’ve retired or been bought out.

I mean, yes, those plays by Carter at the end were damning to the outcome for the Pens...but there are definitely other factors to the loss as well. I think Carter was completely gassed...when you are completely gassed you lose your hands, legs....and brain/decision making...he didnt have his brain on those plays.

I attended opening night 1967 against Montreal I have never been more disgusted with any team in Penguin history This is not a bunch of kids making youth like mistakes These are veterans and should know better But the leadership of this team Management is totally out of touch with reality Somewhat like our Federal Government It is a shame to see this happening and i, for one, and done really caring any more. It is a clown show at best. If you cannot see it I feel sorry for you because you are just as dumb as they are I AM DONE

I find the current perception of this team fascinating.

Youre in the playoff hunt despite being in the tougher conference and arguably the toughest division in the league.

This team has $20M in cap space this summer to resign Jarry and either resign or find replacements for Zucker and Dumoulin.

Am I missing something? This team is in good shape.

I mean the window is most likely closed but I am with you for the most part here. A lot of people like to complain about the potential future but like not a single one of us thought we wouldn't have Kap and McGinn on the roster next season, a few weeks ago.

Its actually close to miracle status the Pens are in the position they are with the goaltending troubles, bottom 6 probs and major D injuries this season all while residing in one of the most Beastly Eastly conferences I can ever remember as a hockey fan.

Carter is on a 35+ contract according to CapFriendly. His year two salary is $250,000 lower than year 1, thus it falls under the 35+ rule. It seems as though this could have been avoided by structuring with a $250,000 signing bonus payable in year 1.

According to capfriendly, it's a 35+. They're not gospel, but they're usually pretty up on thing.

I believe that, since his salary decreases from this year to next, it counts.

Thats f'n bonkers if its the case hahaha oh my. More examples of incompetence. I'd say Carter's agent realized this and Hex didnt.

EDIT: actually, probably doesnt matter on the players end? If he retires he doesnt get salary, anyway, right? Just the team gets the cap hit?

I actually went back and read the comments when he signed the contract and you informed me that they did in fact change the 35+ rules when I said it was a huge risk. My guess is at that time we didn't have complete salary breakdown yet and wrongfully assumed Hextard wouldn't front load the deal.

I looked at 35+ deals too and only found Goligoski, Giordano, MAF, and Suter to have deals that were exempt from the 35+ rules.

So it seems agents try to make sure the deal is structured in a way that makes the deal buyout proof to protect their aging asset.

So Geno, Letang, Carter, PEB, Perry, Ovi, M. Smith, and Crawford all had/have deals subject to those rules.

So only 4 out of the 12 deals have been exempt since the rule change by my count and interesting enough for you guys Billy G signed 2 of those.
