Maybe, maybe not. But there are no laws stating the 1 year or 7 year thing. Because again, companies are now liable for that personal information, therefore theres a lot of misunderstanding of collecting information now days since people have sued others in the past about collecting and not deleting their information. I have to put a disclaimer on my own website stating we collect the information, but if people request us to delete it, we have to delete it. I recognize this is employment, but still, they probably only have a file on the guy that states he is not rehirable and his social security number and things. I recognize that the NFL went back and collected information on Gruden, but then again, Gruden may also have a case that the information they kept in the emails should have been deleted and stripped completely from the servers. The NFL is going to open this whole email stuff wide open, but again, companies should also be eliminating this stuff off their servers over time especially when it private encrypted information. I imagine there are going to be some serious collection of data law changes happening soon based on what's been going on in the NFL and due to this case with the hawks. But I believe a person can ask in writing to a company to eliminate any and all their personal information. Minus obviously the social security information and whether they are hireable and maybe whether they were given notice for their discretions.

Most regulations state 3-7 years. EEOC actually says 1 year. DOn't doubt they are burying stuff, but its well past the 7 years by the time the case was filed.

Why all of it?

And the settlement amount could be argued over for years. You know his lawyers are going to claim he would have made multi millions over a career in the NHL and the Hawks are going to say he was a failed high draft pick who turned out to not to be good enough and was going to make $75K per for however long he played in the minors.

It probably will get ugly like going to NHL arbitration. Longer it goes the happier lawyers and the media become.

The thing is, whether emails exist or not, you would have to subpoena a specific email, topic and time frame. They can't just blanket say "give me all the email ever for so-and-so" and then go on a hunting expedition to find something, and anything not case related is not relevant to the case.

Yes, you are correct. The hawks blocked the plaintiffs lawyer from ANY discovery. What we know about their email retention policies is based on the report from the firm the hawks hired. Not saying that the firm did anything illegal or wrong, it just makes you think a subpoena might unearth some juicy details. That's all I was getting at.

Maybe, but does it really matter? If the Hawks wanted to argue it out, legally they are not really liable for much. They terminated his employment, and the accuser was still employed with them for multiple years after. Sexual Assualt charges were never brought, and if they were it would be against Aldrich, not the team. While the Hawks, Bowman, et al. have been convicted in the court of public opinion, legally in a court, they would win.

Do you know who Sheldon Kennedy is, and his story? If not, you should. He released his autobiography, Why I Didn't Say Anything - The Sheldon Kennedy Story. In the book he revealed that nightmares of Graham James his coach that still continue to plague him.

Not really. Push the issue is all relative in hindsight. 3 weeks between report and Aldrich leaving the club. I have seen harassment/abuse cases at several employers that took months and sometimes up to a year or more to resolve, in retrospect 3 weeks was quick.

Just for the sake of argument, lets play devils advocate,.

Fact: Bowman, et al. did what they should have done and reported it to McD who was the top guy at that point (besides Rocky).

What was then the proper amount of time they should have waited before going over his head? A day? a week? a month? before the next game? How do any of them know what McD did or didn't do to that point. If they ask him, maybe the answer is "I'm taking care of it".

Flash forward lets assume Bowman, et. al. say, you know what, Aldrichs name is not going on the cup and he doesn't get his day with it. Does that make everything better?

Its easy to sit here 10 years later and say what everyone SHOULD have done. It's much harder in the moment.

Lol as a lawyer I love playing devil's advocate. I think the fact his name went on the Cup would indicate it was not being taken care of....yet no one said anything. The "I thought it was taken care of" or "I did not know" is not a very good defense.

I am not talking about everyone either. I am talking about upper management and the coaching staff.

Is someone honestly going to tell me McD could fire someone from upper management or Q or any of the major parts of the coaching staff without Rocky's approval? Don't buy it for a second. All of those guys had employment contracts.

That person would turn around and sue the Hawks for improper termination and that scandal would explode on the spot.

If Q went to Rocky and told him you think McD is going to fire Q in the middle of the playoffs? NO CHANCE
