Medical malpractice is one of the hardest things to prove.

You have to prove you are failing to get "standard of care" and in this case fusion is "standard" but it also may not be the best.

If that case goes to arbitration, you know his side believes there's ample evidence in support of his choice. Hence why he hasn't gone yet. I'm not sure if Dr. Cap is the "#1 guy" as much as perhaps a leading surgeon of the procedure. Semantics aside, the Sabres have the CBA on their side so the burden of proof is on Jack. How many leading ADR surgeons are required? Who knows? My guess, they need several to dispute the team's doctor, and to convince a medical board that Jack's side is correct.

Suggesting a surgery that is obviously and clearly not in the best interest of the patient is exactly that. If this was the case, I guarantee a medical arb would have taken place in June.

The NHL is making a terrible PR move if this is the case.
