There was a suggestion tin the Fried 32 thoughts that if this is not done in the next two weeks Eichel is going to file a grievance against Buffalo.

Could be added pressure, which is not good.

there's really no pressure because there's no grievance to be had...the cba gives the team final say in the matter

the grievance will be defined by Eichel's camp providing ample proof that his preferred method of surgery is not a risk, or equal or less of a risk than fusion surgery. His case, if it proceeds, will be based on the team not having his best medical and professional interests in mind because of the supposed evidence that claims his surgery is of less or equal risk as fusion.

Jack's not going to file a grievance that he knows he'll loooose. Makes jack the athlete look wrong.....

I really think part of the hold up, is the Sabres have all the cards. He can not do what jack wants jack to do....
Probably the 1st time in his life.....

We keep winning, no fan pressure for his return...

Wouldn't a "grievance" on Jack's part take the form of medical arbitration? I mean medical arbitration is part of the CBA for exactly this situation. Why the hell are Jack, the Sabres and the NHL waiting for a mythical trade that isn't happening...move it to arbitration and get the ball rolling to some kind of conclusion ffs.

Didn't the union just agree on terms:

Team doctor has the say.
Sabres pay their doctor for a medical advice
He's the #1 doctor in the field
Fighting a losing battle


No way him wins the case IMO

unless an independent medical arbitrator rules that there is no more of a risk than fusion.

independent is just that, separate from league resources.

maybe...not sure of the details but if so, so be it...the big problem for jack's camp is that it's never been done on an nhl player and within that, the sabres employ the top doctor in that area who says 'no'

In theory once arbitration is over and Eichel gets a treatment, he could recover in time to slot in as 3rd line center for the playoff run

Has there been any actually word that they have a firm "no" to replacement?

Or is it just there is no evidence to support getting replacement where there is evidence to support fusion?

You are right in that aspect, but that doctor has to be agreed upon by the team. Jack went out and got doctors to agree with him, it's his body they have no affiliation with the CBA, so they say yes to him. This could be huge for the Doctor who does this first Disc Replacement of a pro player. Jack isn't gonna be the last hockey player to have a herniated disc. Money Money Money đź’°

Again, the grievance would provide evidence that the Sabres should allow the surgery. The basis is set in the team not having his best interests in mind. Providing evidence that the surgery is just as or less of a short and long term risk as fusion can then be akin to, say, a high ankle sprain. Team says rehab, player says surgery, provides proof surgery is ok, and grievance process forces team to allow surgery.

Of course, the entire case hinges on evidence that his surgery should be accepted.

I agree with you here.

What if and this is just for conversation sake.

Both the Sabres and Eichel get creative with how they approach this?

The Sabres agree to let him have his surgery of choice, if and only if, Eichel waives his NTC completely...

That way he can get his surgery, show he is healthy and is moved where ever Adams gets the best deal.

My thoughts are a trade like this will be extremely tough to pull off mid season. Not to mention there is no "hard deadline" of July 1st like there was with ROR.

It could work out for both sides.
