Except you don't sign a contract with Worker's Comp for millions upon millions of dollars. And the NHL doesn't pay lobbyists millions upon millions of dollars to lobby states to get favorable laws passed so that they don't have to pay for anything.
The players and management bargained for this CBA, everyone went into it knowing what it said, and they all signed on the dotted line.

I'll forever disagree with the bolded part. HIs end of year interview wasn't some clever ploy to get out of here. He wanted to stay, and our GM made a trade for stupid reasons. I don't believe the bonus-owed crap. I firmly believe Botterill panicked at the fan criticism of what ROR said (words I had no problem with him saying). And that decision cost him his job here.

Yes, never read a contract before you sign it, that's common knowledge.
When that much money is at stake you go through it with a fine toothed comb, and then have lawyers do the same.
He also doesn't have to play in the NHL, I'm sure the Russians would give him lots of money, and let him have the surgery of his choice. |

Is it possible that Eichel would agree to the fusion treatment if he were given that advice by a team that traded for him? The idea that this is merely a wedge issue designed to get him out of town should be entertained |

It's a tough situation for all, but I feel for Jack. This isn't a minor surgery with little impact on future health / well being.
It is closer to a decision to go under the old-time scalpel surgery for knee ligaments versus the Arthascoptic procedures of today.
Fushion surgery carries a 5X more likely to require additional Fushions within 10 years ... then again in another 10 years. 3 surgery's in 20 years in which his neck movement becomes further restricted. The data on Replacement surgery is much more promising. Try that on for size by age 45 for all ya'all who read his options as black and white because of a CBA. Imagine you face the same today with Workmans Comp Insurance..no way out. Great!
For these reasons, I'm on the player's side...Jack's side.
For the reasons I identified in a previous post back a couple, Jack's side isn't going to win in arbitration, he knows it, the Sabres know it. I doubt he would win in a legal battle either.
His best option is in The Court of Public Opinion buttressed by the My Body, My Decision argument. IMO, his only real chance is to sit and turn up the heat on the Sabres, the NHL and NHLPA to come to a compromise and amend the CBA in some form or fashion.
That is a low odd options and still doesn't address the issues with Insurance Companies.

If he was some working stiff that made $35K a year and got hurt on the job and the insurance company wouldn't let him get the course of treatment he and his doctor agreed on, then yeah, hell, I AM that guy, and I'll tell you, it sucks when the insurance company says "no, we don't have to pay for that, so we're not going to whether or not it has a high likelihood of working".
He's a grown ass man making $10M a year to play a kids game, and he's acting like a child, so is the team for that matter, but at least they have a leg to stand on.
If Jack didn't know about the rules, he's got no one to blame but himself. How many guys in the league don't get hurt? None. That should be among the first things you seek out; "what happens when, not if, I get hurt?". |

Has Jerry Hughes been doing much? I haven't really been noticing him. I remember in the Miami game he got held once. Maybe what he is doing is freeing others up or something but I wonder if he is worth his 6+ million a year. The Bills drafting Rousseau and Boogie thought they needed help on the line too. |

For me it would be a bigger deal than HRR split, escrow, and the salary cap, all the bullpoop that gets air, and the stuff that really matters gets none.
I hope the players are able to get some more autonomy in the next deal, but the fact remains this is the current deal, and you have to abide by it.
Edit: And there's a process where he can be granted relief, but he's not using it. |
