There is a specific legal definition of incitement that involves taking steps (public communications, etc) to encourage the behaviour. The Democrats will try to demonstrate that his behaviour over a period of time is part of the incitement: promoting the election lie, telling them the country’s future was at stake, telling them to go to the Capitol, egging them in when they were there and already rioting, doing nothing to try to stop them, etc.

1. We won the election.
2. They "stole" the election. IE. they committed a crime against us ...a crime.
3. We must stop the steal. IE. we have to do something.
4. We can't concede. We won't take it anymore.
5. Biden is illegitimate. We can't let that happen.
6. If YOU don't fight like hell we will lose our country.
Never easy any day to prove incitement. But setting legal parameters aside did he in fact incite that crowd full of blindly patriotic dummies to commit a crime .....hell yes.
Legally, he's a fiduciary. His words matter more than the average person.
The fitting punishment isn't time in jail it's letting him know that most of the world views him as a complete joke - poke that narcissistic ego right in his (frank)ing fat ass.

Thank you Mr Law guy. The incitement didn’t start on the 6th. The message of our country being stolen when you were convinced to come to Washington to protect it, 5ne violence of the language, the encouragement when he could see what was happening and the dangers it posed all contribute.
