I'm being very serious, and for millions of dollars a year the lawyer who represents Berglund will be very serious too.

Nothing says he has to show up to games. The clause says he has to devote his "best efforts." It also says he has to follow the Club rules. So he probably did not do that by not showing up to the game.

But that still doesn't answer the question whether missing a week on a five year contract is MATERIAL.

The reason you people are all so angry is becuase you're looking at this as normal, reasonable, human beings. That is why everyone hates lawyers - they look at things differently. I'm not suggesting that Berglund wins this thing, or even has a good argument. But he has AN argument, and that's where settlements happen.

Yes it is. Those 4 years prior are with another "Division/Team"

He has been moved, didn't want to be and is now in breach of contract because of
it.

He really has no leverage other than to show back up and continue playing.

IS Berglunds clause a NMC or NTC because that is very different.

If NTC, send him through waivers assing him to rochester. If he doesn't show then it is breach and bingo bang o, done.

This part is pretty interesting:

"It’s a little puzzling that Doug Armstrong, the GM of the Blues, didn’t check with Berglund or his agent to find out if the Sabres were on the list of acceptable teams he’d agree to be traded to. The harsh reality is the onus completely lies with Berglund’s agent to provide a list."

Wouldn't be surprising to me that GMs start to use this little loophole to get around the NTCs they give out. Not that I blame them, if the player is that set on making sure they don't end up in certain places, then they need to make sure they're proactive and have their lists in in time.

I still can't believe they were able to trade him without the list, but if STL starts doing this, then who would want to sign with them knowing thats how they treat players? (and they don't win)

This could end up as a court battle, I doubt he speaks to it much outside of the facts we already know. Just a hunch.

The team gave him the NTC. The fact that he/his agent didn't submit their list to the league is on them, not on the team.

That's the interesting part there. If the player doesn't submit their list, that's not the teams fault.

I guess in good faith the team could call and say "Hey, is there a reason you didn't submit your list?" but at the same time, that indicates to the player that a trade is imminent and adds a whole new dimension of ugliness. Especially if at the end of the day the player DOESN'T get traded. It's fairly messy either way.

Normally we hear that if a team wants to trade a player with a limited no trade, the team has asked him for his list of teams. This case, they just said you missed the "deadline" we are trading you where ever.

Also, I understand he was moved down the depth chart, but he is a competitive winning team. Would he rather be on STL right now? I guess maybe due to home location, but if he wanted to win at all, he is in a better situation.

The holiday freeze starts tomorrow. Will this have any impact on what happens with Berglund? Also, if the Sabres wanted to look like the 'good guys' in this whole situation they could ask him where he would be willing to play and trade him for anything they could get. Even if it's just 'future considerations' they come out on top showing that they were willing to work with an unhappy player.

My guess is the way we hear it referred to is incorrect. I would guess teams actually contact the league to find out the list. Because as I said before, it makes it messy when the team is actually asking the player for said list.

I tend to agree, unless it is like (us normal folk) get a mass email to everyone saying

"If you have a limited no trade, the list is due no later than Friday"

That way everyone submits it and it is just a formality.

first step will be unconditional waivers

once unclaimed, my guess is the berglund camp won't fight the 3 mil or so he loses so he can go home

does berglund want to fight this losing battle, or go play back home in Jan

my guess is he wants to go back home so they will kowtow to the sabres and take the out to go overseas to recapture as much money as they can


Berglund will then sign the biggest contract in Swedish history and all will be a distant memory by Feb

Yeah, Botts needs to tell him to show up in Rochester, for his new team, if they push too hard. I agree, the Sabres definitely are in the drivers seat. Just want it to work out for the franchise.
