The federal district courts (with no thanks to the Court of Appeals) have created this crazy test to figure out if someone meets the standards. I am thinking about writing my note for Law review about the test and how the different factors have developed within the past few years in the 4 districts courts in New York.

I wrote on Bruch v Firestone Tire & Rubber. Got an opportunity to see it argued in the SCt in my third year.

In the Third Circuit, where I started paying attention, it was a veil piercing case in the context of the go-go world of late 80's corporate mergers. The Supremes decided it as a question regarding the Standard of judicial review for an ERISA fiduciary. I had to entirely rewrite my paper, and never got it through to publication.

Ya....I"m actually kind of praying that the NY Court of Appeals doesn't comment on/lay down a standard for the federal district courts to follow before I can write. But according to Westlaw EDNY is still using this test as of the beginning of this month

This is all evolving in the age of the Internet. I know here in WDNY the case I start with is Chieftan - when phone calls into NY satisfy CPLR.

The technology of The Internet isn't much different than placing a call.

They are almost the same player, Reilly is a better skater but Ristolainen is more consistant in the offensive zone. Both suck at surpressing shots.

That makes sense to me if the person lives in NY. I guess the "conducting business" is the key. What's the standard for that? Or is it changing because of telecoms like you said with Skype? So the business doesn't have to be in the state to conduct business.

I like reading Bill Hoppe's stuff and read it regularly. If Lehner can stay healthy and with the weight loss i think he could be a difference maker for us. I'm certainly hoping so.

I also posted about acquiring Reto Berra from Florida. I don't like the Nilsson acquisition at all. Luongo and Reimer are the goalies in Fla so I would make a trade to get Berra. He can back up Lehner and has 'Murray Size' at 6'4 210.

Interesting. Obviously I'm not a lawyer, but that seems pretty common sense to me. Regardless of whether or not it was an accident, you still used the call for business purposes to a person living in NY. I can see where it would get sticky though.

I wish someone would accidentally call me and offer me a job. That would be awesome! lol

Lol but ya...the test the courts apply is super complex and each factor has like 4 or 5 lower court cases that define the factor.....add to that the fact that the NY Court of Appeals hasn't really ruled on the test and I'm looking forward to writing on this

Since when is ignorance an excuse? But if someone had a Google voice number that you called, and the number was registered in, say, TX, like my actual one is because there were no 716 numbers when I got mine. How would that work? How could you possibly know I'm in NY when you're dialing a TX area code?

I've had enough experience with the law through my worker's comp case to know that the law is anything but common sense. "Oh? You have a chronic condition caused by our client's negligence? We don't pay for that. More importantly the law says we don't have to pay for that, so kindly (frank) off and die." So you only get 8 PT visits a year before you have to switch methods of treatment.

I just made myself 2 chicken "fajitas" and used mighty's bottled hot sauce.

I just had the real deal yesterday. 2 hard shell mightys, medium, because I don't like them drenched in sauce which I recently found out that hot is just medium but more of it. No tomato, small sour cream, again so it doesn't overpower, and then I added Frank's when I got home.

I figured out the "hot sauce thing" when I used to order extra hot. hot is good for me when im home based on volume.
Adding Franks intrigues me.

I was there about 2 years ago with a friend and I asked for "light hot" sauce and she said to me, "you know that hot is just extra medium sauce, right?". I had no idea. So those wieners have just been humoring me for years. lol
