Baffling you don't see the connection. This is the same thing. Smaller scale, granted, but higher profile.
But it's the same problem. |

At what point did Phil Kessel and Dion Phaneuf became victims exactly?
Because all you guys do since december is say how they suck and they should be traded. And now that the media are on their backs, you guys turn around and defend them no matter what?
I have to say, this is hilarious. - Pecafan Fan

Yeah stuff like rapist or child molester is unacceptable. Because that is technically a crime and you can get jail for that. When a person calls you that then that is an attack and ruining personal image.
That has no relation to "affair" type comments that was based on trolls and affairs/divorces has nothing to do with going to jail.... "i saw your wife cheating on you" yet it wasnt true because the person made a false assumption or statement when he could be wrong or right. Same poop |

so we live in a world where name calling is punishable?
to me.. that comment, while mean, isnt illegal.
nor should it be - Dozzer
That sort of accusation is the type of thing that can damage somebody's personal and professional reputation.
They still have burden of proof here, but you bet your ass it can affect the individuals. |

Exactly.
There's a significant difference between calling someone something that is subjective and accusing someone of a having committed a crime or despicable act. |

If you can show that the attack hurt you in some real way (not just your feelings) and is not true then you have grounds for taking it to court. Wedgie would be able to offer up possible defences against the suit - he was clear that he was just issuing his opinion or that he was not being malicious, etc and the courts would decide. |

"Section 2 of the Canadian Charter of Rights and Freedoms is the section of the Constitution of Canada that lists what the Charter calls "fundamental freedoms" theoretically applying to everyone in Canada, regardless of whether they are a Canadian citizen, or an individual or corporation. - Dozzer[1] These freedoms can be held against actions of all levels of government and are enforceable by the courts. The fundamental freedoms are freedom of expression, freedom of religion, freedom of thought, freedom of belief, freedom of peaceful assembly, and freedom of association."

Yes.
"This person slept with this other person" as an individual comment by some random idiot on the internet is not an attack or even worthy of being read or taken notice of.
When it appears on television, it becomes more of a problem. |

It doesn't make any difference if you are accusing someone of committing a crime or sleeping with someone else's wife. If it is untrue, if you know it is untrue, if you said it maliciously and if it causes real harm, there are grounds for libel or slander depending on the medium. |

It's the root of it.
Do I think this specific kid should go to jail? Of course not. But this is high enough profile to get noticed, and this is the exact same attitude and type of thinking that leads to cyber bullying. It's just a first shot.
This kid literally thinks he did nothing wrong, and not just legally. |

speech is expression - Dozzer
A law will be found to violate the freedom of expression where the law either has the purpose or effect of violating the right.
A law's purpose can limit the right either through limiting the content or form of expression. Limits on content are where the meaning of the expression is specifically forbidden by the law, such as hate-speech law, and is the most easily identifiable form of limitation.[10] Limiting the form of the expression can often invoke section 2(b) as it will often have the effect of limiting the content as well.[11]
Where a law does not intend to limit the freedom of expression it may still infringe section 2(b) through its effects.[12] A law will be found to restrict expression if it has the effect of frustrating "the pursuit of truth, participation in the community, or individual self-fulfillment and human flourishing".

League needs to make sure that Rogers does well with its TV deal if it ever hopes to sign another big one. Best way for Rogers to make TV revenues is a long series of playoff runs for the Leafs.
Note - I don't believe that the lotteries are rigged but if they were, this would mean more than Arizona pissing away McDavid. - Canada Cup
Since the Pittsburgh draft pick to get Crosby, i've always thought in the back of my mind that it's rigged. Of course a team thats on a verge of going bankrupt gets the best player - and has been compared to Gretzky for years before his draft year...
He single handedly saved Pittsburgh.... |
