Well they basically gave the stiff arm to NJ when NJ didn't even violate any rules with the original Kovalchuk deal. So for the Flyers to try to get around one, I'm sure the NHL would love to flex its muscles on the first team trying to get around the new CBA to let it be known they won't tolerate that stuff again.
