Seriously, if the League/Owners and Players are as genuine about "just wanting to get back on the ice" as they been saying throughout this entire process, why wouldn't a provision like this be added to the new CBA?
It doesn't benefit one side more than the other and the deadlines "to negotiate" would be bumped up to the summer and early September. With EVERYTHING FOR AN ENTIRE SEASON on the line, both sides would have way more motivation to sort this crap out. - As_I_See_It
That's a fantastic idea, but there would still be a game of chicken, right up to the bitter end. The collective agreement should end, the day after the Stanley Cup is won, in the year it expires. |

... And that is fine as it part of "the process." The bottom line is that it would eliminate both sides from poking around each others posterior with their Richards in an effort to see who can screw the other worse when they know that EVERYTHING is on the line.
Most importantly, it would also save the fans all the time, frustration and the emotional roller coaster that comes with a BS lockout as we are witnessing now and have in the past. |

This idea has one fatal flaw.
Once the CBA expires so would the provision. |

Not really, the wording in the CBA would specifically spell out all of the details, deadlines, etc...for when the new CBA would need to be in place or the upcoming season will be cancelled... |

But if the CBA expired there would be no CBA, which means no provisions of any kind would remain in place. It would have to be written into the league bylaws, not the CBA |

That's the beauty of this type of CBA...It won't expire until a new CBA is reached and will do one of two things: Cancel the upcoming season or be granfathered in for one more season until a new CBA is reached... |

So a CBA without a specific term? No way anyone would sign that. Especially the owners. It would take away their ability to lock the players out.
For a provision like this to work within a CBA there would have to be a CBA. Like I said before, great idea, just write it into the league bylaws, since they don't expire like a CBA does. |

That would be great if they added it to the league bylaws, and I agree with you that all of this is wishful thinking as it hurts the owners way more than it does the players, but it would be a great goodwill gesture and maybe they could word it in such a way to add some NHLPA accountibility as well... |

It would also pressure NHLPA leadership to start bargaining as soon as humanly possible... Say during the entire last season of the CBA. Instead of pulling why Fehr did this time around and wait til the last possible moment to start talks. Those are the kind of time sensitive pressure tactics that need to be removed from both sides of the table.

Yes, these kinds of thiings should have been implemented years ago to ensure the overall health of the league...The way the NHL/NHLPA does things is like watching two five year olds fighting with each other at recess for who's next to use the swing... |
