Employment law is tricky (I've taken a few courses) - automatic transitions into lessor roles cannot be enforced. There is no way in hell Leafs could have forced Lou to remain under Leaf control until after the draft. In all liklihood there were conversations with NYI well before the announcement.

As I mentioned - not worth the paper it was written on. Could not be enforced - under any circumstance. Permission was a formality, and a sign of class on the part of both Lou and Shanny.

Don't need google, if you have a contract for three years at GM and the contract includes a further 3 years as fart the messenger boy, there is not a court in Canada that would side with the employer to force the employee to stay, and unless he signed a non-compete clause (which is unknown) the employee is released from his fiduciary duty upon resignation. There is a basic principle of fairness applied.

Meh. Draft and develop. That way you get control of your own star players and you're not hoping that they come available through Free Agency (which they rarely do).
