Sabres forward Evander Kane will not face criminal charges following an investigation into a possible sexual assault after prosecutors said Friday there was no evidence to support the allegation.

Acting Erie County District Attorney Michael Flaherty announced his decision after examining the facts, including forensic and toxicological test results, and closing a two-month investigation.

"No charge will be filed because there is no evidence to support the filing of a criminal filing of a criminal action," Flaherty said during a news conference. He added that no criminal complaint was ever filed.

A Buffalo judge has officially dismissed charges against Sabres winger Evander Kane stemming from alleged incidents at a local bar last June.

The dismissal Tuesday was based on a plea agreement reached in late October that required Kane to avoid legal issues for six months.

"The time period expired and so the charges were dismissed and the record sealed," Kane's lawyer, Paul Cambria, told The Buffalo News' Harold McNeil.

Kane was charged with misdemeanor trespass and separate noncriminal violations of disorderly conduct and harassment after two female patrons and a bouncer at the bar alleged he had grabbed the women, pulled their hair, and then refused the bouncer's orders to leave.

I don't think the problem most people had was necessarily with the pic itself but the timing of it. I may be wrong but I believe that got put up during a lockout while negotiations (largely about money) were ongoing.

He is the most intense homer but there's some pretty big homers in the trash markets like Florida and Arizona... it's the only way to get people pumped up about it on FOX's 4th tier sports channels
