I think that is referring to him being eligible to met requirements of counting for the expansion draft. Weather he meet the requirements doesn't change weather he can be picked in the draft or not

Only players with 2 or less years on a north american pro contract are exempt.

The rule is that at least one player that is exposed by a team in the expansion draft at F and D has to have played 40 games this season or a total of 70 in the last two. The logic I would guess is that there are sufficient amounts of NHL ready players so Vegas can ice a team.

This does not stop them from selecting another player that has more than 2 years on a pro contract that might be playing in the minor leagues over the player that meets the requirement.
