To preface this, I hate the instigator rule.

It should be 4 on 4; that was a classic case of instigating. Weber committed a 2 minute penalty. Thorburn who wasn't anywhere near the play came down and dropped his gloves with Weber. I think that's what I hate the most is the inconsistency with which they call the instigator.

I remember a game against the Bruins and there was a totally clean open ice hit on a bruin by a Sabre, whom I can't remember, and Scott Thornton came off the bench skated directly to the Sabres player and dropped his gloves even before he got there, they fought and it was 5 on 5. No extra penalties to Thornton, because they said it was a line change, but that's irrelevant, he was out of the play and came into the play and fought.

46.11Instigator - An instigator of an altercation shall be a player who by his actions or demeanor demonstrates any/some of the following criteria: distance traveled; gloves off first; first punch thrown; menacing attitude or posture; verbal instigation or threats; conduct in retaliation to a prior game (or season) incident; obvious retribution for a previous incident in the game or season.
A player who is deemed to be the instigator of an altercation shall be assessed an instigating minor penalty, a major penalty for fighting and a ten-minute misconduct.

Both Thornton and Thorburn were guilty of the bolded actions and neither received the extra penalties. Get rid of the damn rule, or at least call it consistently. Especially in this case there was a penalty coming to Weber, the only reason Thorburn fought him was because of the hit Weber layed on the Jets player. That's literally a text book example, and they blew it.
