It's actually an interesting legal question, which is popping up again and again.

Uber claims they aren't a taxi company, so they have no responsibility.

What is Twitter? Is it a media company like the Star? Or is it like a phone company, where they have no control over what gets said?

It's very blurry because they are the platforms. I think it makes sense as a 3rd party to call these platforms into question. A TSN employee blaming Twitter for this issue is a weak weak deflection.

I think its pretty obvious this is on TSN's shoulders not twitter. They chose not to moderate, they chose to do the whole twittersphere connected thing, which most people (or at least me) dont even care about. I dont see how this falls on Twitter at all.

The author of libelous claims is the one who gets sued. Love to see people start getting charged for tweeting bullpoop.

Some very cool legal issues involved. It's a strict liability claim meaning intent/negligence are both sufficient. The big question is "who published the defamatory comments". The kid, yes. TSN, maybe - depends on how they take that info and place it on their website/broadcast.

Also, this 'bs rumour' has been flying around trashy websites for weeks/months. This kids lawyer will say I read it here, here and here and simply re-published what I already read. It blurs the issue further.

The biggest issue is damages. You can't sue for hurt feelings - you must prove a damage to reputation. I doubt that goes anywhere - especially after TSN and whomever else issues formal apologies.

Just watched Duthie's TSN apology - the clean up begins.

Oh it doesn't exculpate the kid but it's interesting b/c I'm quite sure it's been put out there before (like on here) as fact. The kid probably is one of the posters on here.

That's why these companies are called disruptive. They don't fit into neat little moulds.

Twitter's stance is that it's a platform for people to share what they have to say, and leaves content up to them, only moderating if complaints are received. So long as they follow up with complaints, they're fine.

Megaupload on the other hand had a similar stance, they stored customer data, and allowed to share their data... but took no responsibility for the content outside of responding to complaints... usually in the form of DMCA takedown requests... they didn't fare so well.
