It seems the league takes into affect the actual injury, if any, into account when handing out suspensions. I think it should be on the act and intent as you suggested.

using the orpik and seabrook hits as examples it's easy to see that both hits had intent to injure, which would make orpik's hit illegal, there's no reason why he couldn't have rode him into the boards, the actual hit might be clean, but the intent to injure is what was illegal and should have received a suspension

When I was in New Orleans I was switching channels and found them on at like 7am on channel 100 something. They weren't the same, seemed really controlled in their humour and it was all March Madness.

Seabrook gets 3 games and I believe in part due to Backes being out.

I do agree that fans are pissed that no one else was suspended. The league looks silly and there's no consistency.
