if you want to believe that Phaneuf "dove or dropped" to avoid the hit from Scott, so be it... maybe he didn't want to end up like Erickson... if that's the case and I believe looking at the replay he simply lost an edge with McCormick pushing on him, then good for him. If Datsyuk or Patrick Kane did the same thing you wouldn't be saying a word.

If Tyler Ennis was jumped or asked to fight by Fraser Mclaren would you blame him for swinging his stick at Mclaren... I'm guessing not. Kessel swinging his stick at Scott is a meaningless pre-season game was a reasonable response. Should he have gone back and done it a second time, no he shouldn't... but Scott claims to abide by the code... perhaps going forward he might be more intelligent about who he attempts to fight.

Perhaps a little recent history will help ... you know... when Scott didn't want to be considered a dirty player.
