That won't matter legally. Player A is one of the top NBA players, makes 8 digits a year, and all of a sudden can't make the team because everyone else is on HGH and jumping out of the gym. Is he going to sign the waiver and risk his future health so he can get on the drugs and continue to excel? Hell yeah. Then when health issues do occur (related or not), the league is absolutely (frank)ed.

Law in theory and law in practice are miles apart.
Lawyers don't care about clear-cut, black or white, right or wrong answers. They don't even care to find out what those answers are most of the time. It is not in their best interests to find definitive answers.
Almost all of law is navigating muddy maters: sifting through technicalities, finding ways to "interpret" signed contracts...
Then there is the entirely more complex world of politics to consider: an entire generation of athletes start dropping dead like flies at age 45 from years of abuse to their bodies from substances known to have real risks to human health and you'd better believe the lawmakers would step in.

I get what you're saying but the analogy you are using is just wrong or you're heartless.

I don't see them stepping in when people are blowing their brains out because of concussion related issues. It's a known risk, how is that even arguable? When im working and i know what im doing is potentially harmful or even deadly i have the right to refuse. Its my right.. No one is forcing anyone to take PED's.. I understand your argument and i think it all comes down to who has a better lawyer.

This is about to change soon. There are number of lawsuits before the courts now because of concussions in the NFL. Its only going to take one win before all the leagues start to act.
